If you use our website on behalf of another person or organisation, you represent that you are authorised to act on their behalf.
You agree to use our website only for lawful purposes and in accordance with these Terms. You must not:
-
Use our website for fraudulent, deceptive, or unlawful activities.

-
Attempt to gain unauthorised access to our systems, accounts, or data.
-
Upload or transmit malicious software or harmful code.
-
Copy, scrape, reproduce, or exploit our website content for commercial purposes without our written permission.
-
Provide false, misleading, or incomplete information when placing an order.
We may restrict or suspend access where reasonably necessary to protect our website, customers, or business, subject to applicable law.
3. Our Products
DRIA offers jewellery, including rings, bracelets, and other designs that may be made using gold, silver, lab-grown diamonds, and other materials or gemstones as described in individual product listings.
We aim to provide accurate product descriptions, photographs, specifications, materials information, and pricing. However, certain differences may occur because of screen settings, lighting, photography, production processes, and the natural characteristics of gemstones and materials.
Product images are provided to illustrate the design and appearance of an item. Unless expressly stated, images should not be interpreted as a guarantee that every item will be visually identical in every detail.
Lab-Grown Diamonds and Gemstones
Where a product is described as featuring a lab-grown diamond, that description refers to a diamond created in a laboratory rather than mined from the earth.
Lab-grown diamonds are diamonds, but their characteristics, including colour, clarity, cut, carat weight, and grading, may vary by product. Any grading, certification, or gemstone specification will be provided where applicable and stated in the relevant product listing or accompanying documentation.
We will not represent a gemstone as certified or independently graded unless that representation is supported by the applicable documentation.
Precious Metals
The metal used in each piece will be identified in the relevant product description. Gold purity, silver fineness, plating, vermeil, or other metal treatments will be specified where applicable.
Please review the product description carefully before purchasing. If you require clarification about materials, sizing, gemstone specifications, or care, contact us before placing your order.
4. Product Availability and Design Changes
All products are subject to availability. We reserve the right to modify, discontinue, or update product designs, specifications, descriptions, and prices at any time before an order is accepted, subject to applicable law.
A product displayed on our website does not guarantee that it is currently available for purchase.
If an item becomes unavailable after you place an order, we will contact you and explain the available options, which may include cancellation and a refund.
5. Prices, Currency, Taxes, and Fees
Product prices and the applicable currency will be displayed on our website or at checkout.
Unless otherwise stated, prices do not include additional charges that may apply, such as shipping fees, customs duties, import taxes, or other government charges.
Applicable taxes and shipping costs will be displayed at checkout where our systems are able to calculate them. You are responsible for charges that are legally payable by you and are not included in the displayed purchase price.
For international orders, additional import duties, customs charges, or taxes may apply depending on the destination and local requirements. We will communicate any information available to us about these charges, but we cannot guarantee the assessment made by customs authorities.
6. Orders and Order Acceptance
When you place an order, you submit an offer to purchase the selected products under these Terms.
After submitting an order, you may receive an automated confirmation acknowledging that we have received it. An automated confirmation does not necessarily mean that the order has been finally accepted or dispatched.
We reserve the right to review, decline, or cancel an order where reasonably necessary, including in circumstances involving:
-
Product unavailability.
-
Pricing or listing errors.
-
Suspected fraud or unauthorised transactions.
-
Incorrect or incomplete order information.
-
Payment authorisation failures.
-
Shipping restrictions or legal requirements.
-
Other legitimate operational or security concerns.
If we cancel an order after payment has been collected, we will arrange an appropriate refund to the original payment method, subject to applicable law.
We will not use an order cancellation provision to avoid our legal obligations to customers.
7. Payments
Payment must be completed through the payment methods made available at checkout.
By submitting payment information, you represent that you are authorised to use the selected payment method.
Payments may be processed by third-party payment providers. Their terms and privacy practices may also apply to your transaction.
We may use payment verification and fraud-prevention procedures to protect customers and our business. These checks may require additional information or temporarily delay order processing.
8. Shipping and Delivery
Shipping options, estimated delivery times, applicable charges, and available destinations will be displayed during the purchasing process or in our Shipping Policy.
Delivery estimates are provided for guidance and are not guaranteed unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather, public disruptions, and other unexpected events.
You are responsible for providing an accurate shipping address and contact details. If an address is incorrect or incomplete, please contact us as soon as possible. We cannot guarantee that changes can be made after an order has entered processing or been dispatched.
Our Shipping Policy forms part of these Terms and should be reviewed before purchasing.
Nothing in this section limits any rights or remedies available to you under applicable law concerning delivery, non-delivery, or loss of goods.
9. Returns, Refunds, and Exchanges
Eligible products may be returned in accordance with our Return and Refund Policy, available through our website.
Our standard return policy provides a proposed 30-day return window for eligible, non-personalised jewellery, subject to the conditions stated in that policy.
Customised, personalised, resized, or otherwise altered items may be subject to different conditions, except where applicable law provides otherwise.
Please review the Return and Refund Policy before placing an order. If any provision of these Terms conflicts with a mandatory consumer protection requirement or a specific right stated in our applicable Return and Refund Policy, the mandatory legal requirement or applicable specific policy will govern to the extent of the conflict.
Nothing in these Terms excludes or restricts any non-excludable statutory rights.
10. Custom, Personalised, and Made-to-Order Jewellery
Where offered, custom, personalised, or made-to-order jewellery may require additional time for design approval, production, sizing, sourcing, or quality checks.
Before placing a custom order, please review the specifications, materials, measurements, personalisation details, pricing, and estimated production timeline provided to you.
You are responsible for reviewing and approving the details you submit, including spelling, engraving text, ring size, and design selections.
Once production has begun, changes or cancellations may not be possible. Any applicable cancellation, return, or refund restrictions will be communicated before purchase and will remain subject to applicable law.
If a custom item is defective, incorrectly made, or does not conform to the agreed specifications, you may have rights to a remedy under applicable law.
11. Jewellery Care and Product Use
Jewellery may require appropriate care to maintain its appearance and condition.
We recommend following any care instructions supplied with your purchase. Exposure to chemicals, cosmetics, moisture, impact, abrasion, and improper storage may affect certain metals, finishes, gemstones, or settings.
Unless expressly provided in writing, we do not guarantee that a product will remain free from ordinary wear, surface marks, or changes associated with use over time.
This section does not exclude any warranty or remedy that cannot legally be excluded.
12. Intellectual Property
All website content, including the DRIA name and logo, product photographs, jewellery designs, illustrations, text, graphics, layouts, and other creative materials, is owned by DRIA or used under licence, unless otherwise indicated.
Such content may be protected by copyright, trademark, design, and other intellectual property laws.
You may access and use our website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify, publicly display, sell, or commercially exploit our content without our prior written permission, except where permitted by law.
Nothing in these Terms grants you ownership of our intellectual property or a licence beyond the limited use expressly permitted here.
13. Reviews, Feedback, and Submissions
If you submit a product review, suggestion, comment, or other feedback, you confirm that it is truthful to the best of your knowledge, lawful, and does not infringe another person's rights.
You retain ownership of content you create, subject to any rights you separately grant us.
By submitting content that you choose to make public through our website, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and use that content for operating, improving, and promoting our products and services, subject to applicable law and our Privacy Policy.
We may remove content that we reasonably consider unlawful, abusive, fraudulent, misleading, or otherwise inconsistent with our website rules.
We will not treat private customer communications as public endorsements merely because you contact us.
14. Third-Party Services and Links
Our website may contain third-party applications, payment services, social media features, or links to external websites.
These services are provided by third parties and may be subject to their own terms and privacy policies. We do not control all third-party content or practices and are not responsible for matters outside our reasonable control, subject to applicable law.
Your use of a third-party service is at your discretion, and you should review the relevant provider's terms before using it.
15. Privacy and Personal Information
Our collection and use of personal information are described in our Privacy Policy, available through our website.
By using our website, you acknowledge that your information may be processed as described in that policy, subject to any consent or other legal basis required by applicable law.
Our website is powered by Shopify, which provides the e-commerce platform used to display products, process orders, and support store operations. Shopify and other service providers may process personal information as necessary to provide their services.
Please review our Privacy Policy for further information about data collection, cookies, service providers, retention, and your privacy rights.
16. Errors, Inaccuracies, and Omissions
Occasionally, our website may contain typographical errors, inaccurate product details, pricing errors, incomplete information, or other omissions.
We reserve the right to correct errors and update information where necessary, subject to applicable law.
If an error materially affects an order you have placed, we will contact you and explain the available options. Where an order is cancelled because of a material error, any payment collected for the cancelled order will be refunded as required by applicable law.
We will not rely on this section to avoid fulfilling an accepted order where the law requires us to do so.
17. Disclaimer of Warranties
To the extent permitted by applicable law, our website and its content are provided on an “as available” basis. We do not guarantee that the website will always operate without interruption, delay, or technical error.
Product-specific descriptions, warranties, and representations remain subject to their stated terms and applicable law.
Nothing in these Terms excludes any warranty, guarantee, consumer right, or remedy that cannot lawfully be excluded or limited.
18. Limitation of Liability
To the extent permitted by applicable law, DRIA will not be liable for indirect or consequential losses that are not reasonably foreseeable and arise from the use of our website or services.
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by law, including liability for fraud, intentional misconduct, or other liability that cannot legally be limited.
Where applicable law permits a limitation of liability, the extent of that limitation will be determined in accordance with that law and the circumstances of the claim.
19. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, and reasonable costs directly arising from your unlawful use of our website, your material breach of these Terms, or your infringement of another person's rights.
This provision does not apply to the extent a loss results from our own unlawful conduct or where indemnification is prohibited by applicable law.
20. Suspension and Termination
We may restrict or suspend access to our website where reasonably necessary to address security risks, suspected fraud, unlawful activity, or material violations of these Terms.
Where appropriate and legally permitted, we will take reasonable steps to notify affected users.
Termination or suspension does not affect rights or obligations that have already accrued, nor does it remove any consumer rights relating to an order already placed.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, products, website functionality, or legal requirements.
The latest version will be published on this page with an updated revision date. Changes will apply from the date stated in the updated Terms, subject to applicable law.
Changes will not retroactively remove rights that have already accrued to you or alter an existing transaction where doing so would be unlawful.
We encourage you to review this page periodically.
22. Governing Law and Disputes
These Terms are subject to the laws applicable to the business operating DRIA Fine Jewellery, without overriding mandatory consumer protection laws that apply to you.
Any dispute will be handled by the courts or other dispute-resolution bodies that have jurisdiction under applicable law.
The governing law, business jurisdiction, and appropriate dispute-resolution provisions should be confirmed and completed once our legal business details and intended sales territories are finalised.
23. Severability and Waiver
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure or delay in enforcing a provision does not constitute a waiver of our right to enforce it later.
24. Entire Agreement
These Terms, together with the policies and terms expressly incorporated by reference, govern your use of our website and your purchases from DRIA, subject to any separate written agreement and applicable law.
If a provision of another applicable DRIA policy addresses a specific subject in greater detail, that provision will apply to that subject to the extent consistent with these Terms and applicable law.
